Where the lessor has resumed possession of the dwelling-

house under the provisions of article 12C and it is proved that there has been simulation or fraud, the lessor shall be bound to pay, in lieu of damages, to the tenant who has quitted the dwelling-house a penalty not exceeding ten thousand euro (€10,000) to be fixed by the Board.
