(1) This article applies to any person accused of an offence under the law of Malta who is returned to Malta as mentioned in article 25(1).

(2) If, in the case of a person to whom this article applies, either -

(a) proceedings against him for the offence for which he was returned or for an offence for which he may be dealt with in accordance with article 25(2)(b) or (c) are not begun within the period of three months beginning with the day of his arrival in Malta on being returned; or

(b) on his trial for that offence, he is acquitted, or he is discharged absolutely or conditionally under the provisions of the Probation Act, the Minister may, if he thinks fit, on the request of that person, arrange for him to be sent back free of charge and with as little delay as possible to the country from which he was returned.
