Cap. 416 чл. 92Effects of registration infringement.

(1) Upon the coming into force of this Act articles 9 to 12

of this Act shall apply in relation to an existing registered mark and subject to sub-article (2) hereof, article 14 of this Act shall apply in relation to any infringement of an existing registered mark committed after the commencement of this Act.

(2) After the coming into force of this Act, it shall not be an infringement of -

(a) an existing registered mark, or

(b) a registered trademark of which the distinctive elements are the same or substantially the same as those of an existing registered mark and which is registered for the same goods or services, to continue with any use which did not amount to infringement of the existing registered mark under the Old Law.
