Where in respect of a person charged before the Courts of Magistrates as a court of criminal inquiry a court has made an order for his temporary surrender to a foreign State requesting his extradition or to any other foreign competent authority requesting his surrender, the terms referred to in article 402(1) shall, from the date of his return to Malta, recommence to run anew.
