Cap. 12 Art. 730Certain pleas to be determined under separate heads.

Any plea to the jurisdiction of the court or to the capacity of the parties, and any plea of compromise, arbitration, res prescription, or nullity of acts, shall be determined under judicata, a separate head, either before, or together with the decision on the merits.
