Cap. 16 Art. 1552When damages may not be claimed.

The provisions of the last preceding article in respect of the liability for damages shall not apply -

(a) if the lessee fails to give notice to the lessor, without delay, of the molestation, and the lessor is prejudiced by such omission;

(b) if the cause of the action referred to in the last preceding article, has only arisen after the stipulation of the contract, and is not due to an act of the lessor;

(c) if, at the time of the contract, the lessee knew of the right of the third party.
