Cap. 296 Art. 49Conversion of title into a guaranteed title.

(1)(a) Upon the lapse of the time referred to in article 23(2), the registrar shall, subject to the following sub-article after giving such notice, if any, as may be prescribed, register such title as a guaranteed title whether the proprietor consents to such registration or not. this article and any other provision of this Act, after giving such notices, if any, as may be prescribed, remove any qualification entered in the register in terms of this Act, whether the proprietor consents to such removal or not.

(2) If any claim adverse to the title of the proprietor has been made, an entry shall not be made on the register under this article unless and until the claim has been disposed of.

(3) Any person, other than the proprietor, who suffers loss by reason of any entry on the register made by virtue of this article shall be entitled to be indemnified under this Act as if a mistake had been made in the register.
