Saving as provided by article 4 of the Agreement, or where any other provision of the Agreement provides otherwise, the

Government shall succeed the ecclesiastical entities in all real rights, interests, obligations, burdens, (with the exclusion of pious burdens), and actions pertaining to the properties transferred to it by virtue of the Agreement.

(2) The provisions of the Code of Organization and Civil

Procedure relating to arbitration shall in so far as they are not inconsistent with the provisions of subarticle (1) or of paragraph 1 of article 13 of the Agreement or unless otherwise agreed between the Government of Malta and the Maltese Episcopal Conference, shall apply to an arbitration as is referred to in subarticle (1).
