(1) The Commissioner shall deliver the goods to the importer or to the person producing to him the original Custom House schedule relating to such goods, signed by the said importer; and the Commissioner shall thereupon be discharged from all further liability towards any other person whomsoever in respect of such goods: unless such goods shall have been lawfully attached, before delivery, by means of a garnishee order issued against the person producing such Custom House schedule.

(2) In the case of partial delivery of the goods described in the Custom House schedule, as provided in article 38, the Commissioner shall endorse on the schedule the quantity delivered, corresponding with the entry in the books of the Custom House, and return the said schedule to the person producing the same.
