Cap. 416 Art. 13Registration subject to disclaimer or limitation.

(1) An applicant for registration of a trademark, or the proprietor of a registered trademark, may -

(a) disclaim any right to the exclusive use of any specified element of the trademark, or

(b) agree that the rights conferred by the registration shall and entry in the register of a disclaimer or limitation.

(4) Where the registration of a trademark is subject to a disclaimer or limitation, the rights conferred by article 9 shall be restricted accordingly. Infringement proceedings
