Cap. 571 · cap/571 (Cap. 571)

Cap. 571 Art. 9Maintenance claims.

In KraftAmtlicher Text

(1) If a maintenance claim for dependent children is contested by one of the cohabitants in accordance with article 8(g), the competent Court shall not take the amount indicated by the cohabitants as maintenance in the contract governing the cohabitation between the parties as fixed, provided that this amount is intended to be a minimum amount and not necessarily an appropriate one. Provided that where the Court finds that the cohabitant which is obliged to pay the said maintenance has lost his employment without fault, the Court may consider fixing maintenance in an amount which is lower than the amount indicated by the cohabitants as the minimum amount that shall be given as maintenance for any dependent children in the contract, as well as indicating that the full amount of maintenance shall be immediately due as soon as the cohabitant which is obliged to pay the said maintenance finds employment.
