(1) This Act applies to every trademark in respect of goods or services which is the subject of registration or of an application for registration in Malta as an individual trademark, a certification mark or a collective mark or of an international registration having effect in Malta.

(2) This Act transposes the provisions of Directive (EU) 2015/ 2436 of 16 December 2015 to approximate the laws of the Member States relating to trademarks (Recast).

(3) The processing of any personal data carried out in Malta in the framework of this Act shall be subject to Regulation 2016/679

(EU) and the Data Protection Act.
