S.L. 123.51 Art. 5Non-prescribed fund.

(1) A fund in an overseas-based scheme shall be treated as a non-prescribed fund.

(2) When a Malta based scheme declares in the manner provided for in these regulations that a fund does not satisfy the conditions set out in regulation 4(a) or (b), as the case may be, the Commissioner shall classify that fund as a non-prescribed fund.
