S.L. 370.19 Art. 9Obligations of the depositary.

The depositary of the merging UCITS and the depositary of the receiving UCITS shall both verify the conformity of the following elements with the requirements of the UCITS Directive and the fund rules or instruments of incorporation of their respective UCITS:

(a) the identification of the type of merger and the UCITS involved;

(b) the planned effective date of the merger; and

(c) the rules applicable respectively to the transfer of assets and the exchange of units.
