S.L. 370.24 Art. 29Peer review of authorisation and supervision of non- EU AIFMs.

(1) The competent authority shall make every effort to comply with guidelines and recommendations issued by ESMA in terms of Article 38 of the AIFM Directive.

(2) Within two months of the issuance of a guideline or recommendation, the competent authority shall confirm whether it complies or intends to comply with such guideline or recommendation. In the event that the competent authority does not comply or intend to comply, it shall inform ESMA, stating its reasons.
