S.L. 370.5 Art. 1Citation and scope.

(1) The title of these regulations is the Investment Services

Act (Control of Assets) Regulations.

(2) These regulations shall not apply to depositaries of collective investment schemes, which shall be regulated by the Investment

Services Act (Depositaries of Collective Investment Schemes) Regulations.

(3) The objective of these regulations is to implement the relevant provisions of Articles 1(3) and (4) and Articles 2 to 8 of the Commission Delegated Directive (EU) 2017/593 of 7 April 2016 supplementing Directive 2014/65/EU of the European Parliament and of the Council with regard to safeguarding of financial instruments and funds belonging to clients, product governance, obligations and the rules applicable to the provision or reception of fees, commissions or any monetary or non-monetary benefits.
