(1) Where -

(a) an arrangement has been entered into between a

Maltese insurance undertaking and its creditors in terms of article 291 of the Companies Act;

(b) an order has been made appointing a provisional administrator in accordance with article 228 of the Companies Act;

(c) a winding up order has been made by the court under
