S.L. 403.15 Art. 24Creditor’s right to set off.

(1) The adoption of reorganisation measures or commencement of winding up proceedings shall not affect the rights of insurance creditors to demand the set-off of their claims against the claims of the Maltese insurance undertaking.

(2) Sub-regulation (1) does not preclude actions for nullity, voidability or unenforceability of legal acts detrimental to all the creditors as referred to in regulation 10(3)(m).
