(1) Only measuring container bottles which meet the requirements of these regulations may be marked with the EEC sign provided for in the third sub-paragraph of paragraph 5 of Annex 1.
(2) Such bottles shall be subject to meterological control under the conditions specified in the Annexes.
(3) The marketing and use as measuring containers of bottles which satisfy the requirements and tests laid down in these regulations may not be refused, prohibited or restricted for reasons concerning their volume, the determination of their volume or the methods by which they have been checked.
*See regulation 1(2) of these regulations as originally promulgated, and Legal Notice 217 of 2006. ANNEX I Measuring container bottles shall be characterized by the following which are always specified for a temperature of 20°C: nominal capacity V is the volume which is marked on the bottle; it n of liquid which the latter is deemed to contain when it is filled in the use for which it is intended; brim capacity of the bottle is the volume of liquid it contains when brim; actual capacity of the bottle is the volume of liquid it in fact contains filled exactly under the conditions corresponding theoretically to the capacity.
There are two methods of filling measuring container bottles:
(a) to a constant level,
(b) to a constant vacuity. between the theoretical filling level for the nominal capacity and the the difference between the brim capacity and the nominal capacity, volume of expansion or vacuity, shall be perceptibly constant for all same type, that is, for all bottles made to the same design.
order to make it possible, allowing for the usual uncertainties in measure the volume of the contents of measuring container bottles with accuracy, and in particular with the accuracy required by the regulations prepackages, the maximum permissible errors (positive or negative) in the measuring bottle container, i.e. the greatest differences permitted negative) at the temperature of 20°C and under the control conditions Annex II, between the actual capacity and the nominal capacity V shall n accordance with the following table:
Maximum permissible errors capacity V in millimetres n as a % of V in millilitres n 100 - 3 to 200 3 -to 300 - 6 to 500 2 -to 1000 - 10 to 5000 1 -
maximum permissible error in the brim capacity shall be the same as the permissible error in the corresponding nominal capacity.
systematic exploitation of tolerances shall be prohibited. practice, the actual capacity of a measuring container bottle shall be determining the quantity of water at 20°C, which the bottle actually filled to the level theoretically corresponding to the nominal capacity. checked indirectly hy method of equivalent accuracy. Every manufacturer of measuring container bottles shall submit for the competent authority a mark by which he can be identified. authority has given its approval, it shall inform the competent parties thereof within one month. The manufacturer shall, on his own responsibility, affix the sign epsilon) referred to in regulation 6 of the Measuring Instrument and Metrological Control Regulations, certifying that the bottle meets the of these regulations and of the Annexes thereto. However, the date, reference number provided for in Annex I, paragraph 6.3 to the same shall not be required.
This sign shall be at least 3 mm high.
