S.L. 459.1 Art. 3AValidity of financial collateral arrangement.

(1) A financial collateral arrangement shall be valid and enforceable in accordance with its terms and with these regulations.

(2) Article 1357(2) of the Civil Code shall not apply to a financial collateral arrangement and the terms agreed upon between the parties shall prevail.

(3) Where any of the provisions of the Civil Code, the Code of Organization and Civil Procedure, the Companies Act, the

Companies Act (Investment Companies with Variable Share Capital)

Regulations or any other law is in conflict with any of these regulations, these regulations shall prevail.
