The obligation referred to in regulation 5(1) shall apply to the plans and programmes of which the first formal preparatory act was subsequent to the 21st July, 2004. Plans and programmes of which the first formal preparatory act was before this date and which are adopted or submitted to the legislative procedure more than twenty-four months thereafter, shall be made subject to the obligation referred to in regulation 5(1) unless the responsible authority decides on a case by case basis that this is not feasible and informs the public of its decision.
