Cap. 12 Art. 400Capacity of parties in reconvention.

The defendant may not set up a counter-claim in a capacity other than that in which he has been sued, nor may he, in setting up the counter-claim, sue the plaintiff in a capacity other than that in which the plaintiff has claimed.
