Cap. 12 Art. 414Effects of default by jactitator totake fresh proceedings.

If, within the time renewed as provided in the last preceding article, the jactitator fails to institute fresh proceedings, the plaintiff in the jactitation suit may demand, by sworn application before the court which fixed the original time, that perpetual silence be enjoined on the jactitator in regard to the claim which he had brought for trial.
