Cap. 12 Art. 776Procedure.

Where the issue has not been brought before the Court of Appeal by an appeal in the ordinary way, it shall be lawful at any time for the purposes of the last preceding article, to make an application to that court and that court shall, after hearing the parties, determine which of the said courts is the competent court.
