Cap. 569 Art. 51Unauthorised provision of residential care.

Any person or organisation that establishes, operates or maintains a residential home, or provides, directly or indirectly, residential care without the written approval of the Care Standards Authority shall be guilty of an offence and shall on conviction be liable to imprisonment for a term of not less than twelve months and not exceeding four years or to a fine (multa) of not less than five thousand euro (€5,000) but not more than ten thousand euro (€10,000), or to both such fine and imprisonment.
