Cap. 9 Art. 602Default of filing indictment within prescribed time.

Where the indictment is not filed within the prescribed time, the court may, at the request of the accused, and after hearing the Attorney General, order the discharge of the accused, and the provisions of article 434 shall, apply: mutatis mutandis,

Provided that this provision shall not apply if at the time the request is made the indictment shall have been filed.
