S.L. 12.9 Art. 16Taking of evidence abroad between EU Member States.

(1) Notwithstanding the provisions of Part III of the Legal

Procedures (Ratification of Conventions) Act, the provisions of

Regulation (EU) No 2020/1783 of the European Parliament and of the

Council of 25 November 2020 on cooperation between the courts of the Member States in the taking of evidence in civil or commercial matters (taking of evidence) (recast) shall apply to matters falling within the scope of the said Regulation.

(2) The provisions of Part III of the Legal Procedures (Ratification of Conventions) Act, incorporating into Maltese law the Convention on the Taking of Evidence Abroad on Civil or Commercial Matters, signed at the Hague on 18 March 1970 shall apply to those state parties to the said Convention and to those European Member States which are not participating and bound by the provisions of the above-mentioned Regulation (EU) No 2020/ 1783 of the European Parliament and of the Council and any amendments to such Regulation which may be applicable to Malta from time to time.

(3) All civil courts shall have jurisdiction to execute letters of request made in terms of Regulation (EU) No 2020/1783 of the European Parliament and of the Council.
