S.L. 449.31 Art. 8Compliance with general requirements.

(1) Subject to sub-regulation (2), the proprietor of a food business shall comply with the provisions set out in the Schedule.

(2) The proprietor of a food business may derogate from compliance with the provisions of hygiene as set in the Schedule provided that such proprietor does so in accordance with Commission Directive 96/3/EC as amended by Commission Directive 2004/4/EC (corrected version) or in accordance with Commission Directive 98/28/EC. SCHEDULE

(Regulation 8) This schedule provides the regulatory framework for ensuring the hygiene and safety of food and shall be applicable as follows: - Part I to all food premises except those covered by Part III; - Part II to all rooms where food is prepared, treated or processed except those covered by Part III and excluding dining areas; - Part III to those premises listed in the heading to that Part; - Part IV to all transportation; and Parts V to IX of this Schedule apply throughout all stages after primary production during preparation, processing, manufacturing, packaging, storing, transportation, and distribution, handling and offering for sale or supply to the consumer.
