S.L. 549.49 Art. 11New information on risks of contained use.

(1)(a) If new information subsequently becomes available to the competent authority which could have significant consequences for the risks posed by the contained use, the competent authority may require the user to modify the conditions of, or suspend or terminate, the contained use.

(b) Where a user becomes aware of new information or modifies the contained use in a way which could have significant consequences for the risks posed by it, the user shall discontinue the contained use and, as soon as practicable, inform the competent authority.

(2) Prior to resuming a contained use discontinued in accordance with sub-regulation (1), the user shall -

(a) review the assessment carried out in accordance with regulation 4, and the class and level of containment applied in accordance with regulation 4(2); and

(b) submit an amended notification to the competent authority.

(3) For the purposes of sub-regulation (2) the provisions in relation to the submission of a notification by a user in accordance with regulations 6, 8 or 9, and to the processing and determination of such a notification by the competent authority in accordance with regulation 10, shall apply, as appropriate, to an amended notification as if it were a notification under regulations 6, 8 or 9.
