Subject to the provisions of articles 49 and 53, a Local

Council shall designate a Deputy Executive Secretary from the employees in scale 11 and above of the Council to exercise the functions of the Executive Secretary whenever the office of

Executive Secretary is vacant or the Executive Secretary is for any reason unable to act. The Executive Secretary shall give due notice to the Council in writing of any instance where he is unable to act: Provided that if in that particular Local Council none of the employees are of the scale required, the Deputy Executive Secretary shall be designated from another Local Council as long as he has the required qualifications.
