S.L. 427.89 Art. 3National Register of Traditional Agro-food Products of Malta.

(1) The Director shall keep a register, to be called the National Register of Traditional Agro-food Products of Malta, in which there shall be registered all approved products.

(2) The inclusion of a product in the above mentioned Register of approved products shall not constitute a registration in terms of

Regulation (EU) No 1151/2012 on quality schemes for agricultural products and foodstuffs.

(3) The name of any product in the Register shall be without

*These Regulations have been transposed to Cap 639, see S.L. 639.03. - See Act XXXIII of 2023. prejudice to the name chosen for the purpose of registration of a product in terms of Regulation (EU) No 1151/2012 on quality schemes for agricultural products and foodstuffs.

(4) Starting from the date of the coming into force of these * regulations and without prejudice to Regulation (EU) No 1151/ 2012 on quality schemes for agricultural products and foodstuffs, the inclusion of a name in the Register shall preclude any person from lodging an application for protection of that name under EU and national laws concerning intellectual and industrial property.
