S.L. 330.7 ст. 28Burden of proof.

(1) Any contractual term or condition contained in a distance contract providing that the burden of proof of the supplier of all or part of the obligations incumbent on the supplier pursuant to these regulations should lie with the consumer shall be an unfair term within the meaning of Council Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts.

(2) Without prejudice to regulation 8(5), the burden of proof shall be placed on the supplier in any dispute relating to -

(a) the content of the information supplied to the consumer in accordance with regulation 5;

(b) the consent of the consumer to the conclusion of any distance contract; and

(c) the compliance by the supplier with the time-limits prescribed under these regulations.
