(1) Official controls shall be carried out by the department in accordance with Article 3 of Regulation (EC) No 882/2004 on aquaculture production businesses and authorised processing establishments.

(2) The official controls provided for in sub-rule (1) shall consist of regular inspections, visits, audits, and where appropriate, sampling, for each aquaculture production business, taking account of the risk the aquaculture production business and authorised processing establishment poses in relation to the contracting and spreading of diseases. The frequencies of such controls depend on the health status of the concerned zone or compartment and should be fixed in accordance with the recommendations set out in Schedule III.

(3) Detailed rules for the implementation of this rule may be adopted in accordance with the procedure referred to in rule 62(2).
