S.L. 449.53 ст. 3Notification to the competent authority.

(1) To facilitate efficient monitoring, when a food bearing a nutrition claim listed in the Annex of Regulation (EC) No 1924/

2006, or a health claim is placed on the market for the first time, the manufacturer or importer shall notify the competent authority by forwarding a model of the label used for the product.

(2) In the case of food bearing health claims placed on the market prior to the entry into force of these regulations, the notification prescribed by sub-regulation (1) shall take place by not later than 30th June 2008. Foodstuffs which have not been notified by that date shall be removed from the market at the expense of the manufacturer or importer.

(3) (a) In the case of food bearing nutrition claims placed on the market prior to the entry into force of these regulations, the notification prescribed by sub-regulation (1) shall take place by not later than:

(i) 30th June, 2008 for food bearing nutrition claims referring to fat;

(ii) 31st December, 2008 for food bearing nutrition claims referring to energy;

(iii) 30th June, 2009 for food bearing nutrition claims other than those referred to in sub-paragraphs (i) and (ii).

(b) Foodstuffs which have not been notified by the dates prescribed in paragraph (a)(i), (ii) and (iii) shall be removed from the market at the expense of the manufacturer or importer.
