(1) These regulations apply to ships of 300 gross tonnage and upwards, unless stated otherwise in these regulations.

(2) Unless otherwise provided, these regulations shall not apply to:

(a) warships, naval auxiliaries;

(b) ships owned or operated by the Government of a Member State which are used for non-commercial public service;

(c) fishing vessels, traditional ships, recreational craft with length of less than 45 metres; and

(d) bunkers on ships below 1,000 gross tonnage and ship’s stores and equipment for use on board all ships.
