S.L. 517.2 ст. 11Recorded data to constitute conclusive evidence.

The data recorded on the system used or recognised by the

Commissioner for the purpose of electronic communications to which these rules refer shall constitute conclusive evidence as to:

(a) the identity of the sender of that communication;

(b) the identity of the receiver of that communication;

(c) the contents of that communication;

(d) the delivery of the communication;

(e) the date and time of the delivery of the communication:

Provided that this rule shall not apply when it is proved that, on account of any technical default in the said system, the relevant data is not retrievable or is incomplete or is not reliable.
