S.L. 420.5 Art. 6Existence of a mass influx of displaced persons.

(1) The existence of a mass influx of displaced persons shall be declared by the Chief Executive Officer. Such declaration shall be based on a Council Decision establishing the existence of a mass influx adopted by the Council of the European Union, on a proposal from the European Commission, and adopted by qualified majority, in accordance with the provisions of Directive 2001/55/EC.

(2) The Chief Executive Officer’s declaration in accordance with sub-regulation (1) shall have the effect of introducing in Maltatemporary protection for the displaced persons to which it refers, in accordance with the provisions of these regulations.
