These regulations shall apply to a commercial vessel when it is water-borne, moored or anchored:

Provided that if such commercial vessel is berthed, moored or anchored, but is not regularly used in accordance with the uses for which it is certified, its owner shall comply with any requirements in respect of such vessel as the Authority may prescribe from time to time.
