S.L. 549.44 ст. 36Access to genetic resources.

(1) Without prejudice to the Trade in Species of Fauna and

Flora Regulations, and the Access to Genetic Resources and the

Fair and Equitable Sharing of Benefits arising from their

Utilisation Regulations and the related regulations, access to wild fauna and flora to countries other than Malta shall be subject to prior informed consent of the competent authority, provided that wild birds and pathogens are excluded from this provision.

(2) Access, where granted, shall be on mutually agreed terms and subject to the provisions of the Access to Genetic Resources and the Fair and Equitable Sharing of Benefits arising from their Utilisation Regulations.
